The most likely answer is for me more than 12 inches tall. Not sure if such a hat in general are responsible for their wakes when negative results because of the speed boat and then probably your fault.
I do not know if there are size restrictions on vessels in MN, but some larger vessels, especially in displacement hulls are not able to give the signal of less than 12 inches.
I would say that since the question is to be read "is a legal thing to do is" A "All three options could lead to the destruction of property or personal injury or death of any person.
